Federal Court Orders Release of Abrego Garcia from ICE Detention

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.

"Since his return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation stems from a erroneous deportation to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to answer alien smuggling allegations, he was held in immigration custody.

In her order, the court noted that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

The legal proceedings center on disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in Tennessee.
